4. Account Registration and Security
4.1 Registration
Certain features of the Service require you to create an Account. You agree to provide accurate, current, and complete information during registration and to keep your Account information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately at contact@pimnarek.com if you suspect any unauthorized access to your Account.
4.3 Account Sharing
Accounts are personal and non-transferable unless expressly permitted under your Subscription plan. Sharing login credentials with third parties is prohibited unless your plan explicitly supports multi-user access.
5. Permitted Use
You may use the Service solely for lawful purposes and in accordance with these Terms of Use. You agree to use the Service only in ways that are consistent with its intended purpose of deploying and managing chatbot solutions across platforms.
6. Prohibited Conduct
You must not use the Service to:
- Violate any applicable law or regulation.
- Transmit or distribute malware, viruses, or any harmful code.
- Engage in unauthorized scraping, crawling, or data extraction.
- Attempt to gain unauthorized access to any system, network, or data.
- Impersonate any person or entity or misrepresent your affiliation.
- Harass, abuse, or harm any other person.
- Use the Service to send unsolicited commercial communications in violation of applicable rules.
- Circumvent any technical measures or access controls implemented in the Service.
- Resell, sublicense, or otherwise commercialize the Service without explicit written authorization.
- Interfere with the integrity, performance, or availability of the Service.
7. Subscriptions and Payments
7.1 Subscription Plans
Access to certain features requires a paid Subscription. Details of available plans, pricing, and included features are described on the Service website and may be updated periodically.
7.2 Billing
Subscription fees are billed in advance on a recurring basis according to the billing cycle you select. All fees are stated in the currency displayed at checkout and are inclusive or exclusive of applicable taxes as indicated.
7.3 Payment Authorization
By providing payment information, you authorize us to charge the applicable fees to your designated payment method. You are responsible for ensuring your payment details remain current and valid.
7.4 Failed Payments
If a payment fails, we may suspend or restrict access to the Service until outstanding amounts are settled. We will make reasonable efforts to notify you of payment failures before taking action.
7.5 Price Changes
We reserve the right to modify Subscription pricing. We will provide reasonable advance notice of any price changes. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
8. Cancellation and Refunds
8.1 Cancellation
You may cancel your Subscription at any time through your Account settings or by contacting us. Cancellation takes effect at the end of the current billing period, and you retain access to the Service until that date.
8.2 Refunds
Subscription fees are generally non-refundable except where required by applicable law or as expressly stated in a separate written agreement. Requests for exceptions may be submitted to contact@pimnarek.com and will be evaluated on a case-by-case basis.
9. Intellectual Property
9.1 Our Intellectual Property
All rights, title, and interest in the Service, including its software, design, trademarks, logos, and documentation, are owned by or licensed to Pimnarek. Nothing in these Terms of Use grants you any ownership rights in the Service or its components.
9.2 License to Use
Subject to your compliance with these Terms of Use and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal purposes during your Subscription period.
9.3 Your Content
You retain ownership of Content you submit to the Service. By submitting Content, you grant us a limited license to host, process, and transmit that Content solely as necessary to provide the Service to you. We do not claim ownership of your Content.
9.4 Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without restriction or compensation to you.
10. Third-Party Integrations and Platforms
The Service may enable integration with third-party platforms, messaging channels, and APIs. Your use of such third-party services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. You are solely responsible for ensuring your use of third-party integrations complies with the applicable third-party terms.

13. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee that any results obtained through the Service will be accurate or reliable.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Pimnarek and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service.
Our total cumulative liability to you for any claims arising under these Terms of Use shall not exceed the total fees paid by you to us in the twelve months preceding the event giving rise to the claim.
15. Indemnification
You agree to indemnify, defend, and hold harmless Pimnarek and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your Content, your violation of these Terms of Use, or your violation of any applicable law or third-party rights.
16. Service Availability and Modifications
We strive to maintain consistent availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes where practicable.
17. Termination
17.1 Termination by You
You may terminate your Account and stop using the Service at any time by cancelling your Subscription and deleting your Account through the available settings.
17.2 Termination by Us
We may suspend or terminate your access to the Service with or without notice if we reasonably believe you have violated these Terms of Use, engaged in fraudulent activity, or if continued access poses a risk to the Service or other users.
17.3 Effect of Termination
Upon termination, your license to use the Service ends immediately. Provisions of these Terms of Use that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will remain in effect.
18. Governing Principles
These Terms of Use are intended to be interpreted in a fair and reasonable manner consistent with their plain meaning. Any dispute arising from these terms will be resolved through good-faith negotiation between the parties before any formal proceeding is initiated. 19. Severability
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms of Use, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and Pimnarek regarding your use of the Service and supersede all prior agreements and understandings relating to the same subject matter.
